Terms of Use

In short

  • Flits shows you deals from cafés, restaurants and other venues nearby. The venue provides the deal; Flits is the platform that connects you.
  • You claim table deals for free and pay at the venue. If you don't turn up or cancel too late, you get a strike and your reliability score drops.
  • You buy and pay for takeaway deals in advance in the app. You are buying from the venue. Cancellations and refunds are covered in the Cancellation & Refund Policy.
  • You have one account with one verified mobile number. Venues never see your number or your location.
  • Use Flits fairly: no fake accounts, no abuse, no false reports. If we take action against you, we tell you why and you can appeal.
  • Flits is free for guests. You never pay service fees.

1. Who we are and what these terms cover

1.1 Flits is a service of Nafite B.V., trading as Flits, located at Spoorstraat 30A, 6511 AH Nijmegen, registered with the Netherlands Chamber of Commerce (KvK) under number 76060217, VAT number NL860493222B01. In these terms we call ourselves "Flits", "we" or "us". You can reach us through Help in the app or at info@nafite.com.

1.2 Flits is one app with a guest mode and a business mode. These terms apply to using the app as a guest. Venues and their staff are also bound by the Partner Terms.

1.3 The website joinflits.com is only there to promote Flits. You claim and buy deals in the app.

1.4 How we handle your personal data is explained in the Privacy Notice. Cancelling and refunding deals is covered in the Cancellation & Refund Policy, which forms part of these terms.

1.5 By creating an account, you agree to these terms.

2. What Flits does, and what the venue does

2.1 Flits is a platform. We show deals from hospitality venues, handle claiming and in-app payment, and help when something goes wrong. We are not a venue ourselves.

2.2 The venue is the provider of the deal. Every venue on Flits is a business (trader) registered with the Chamber of Commerce. Each deal shows which venue is the provider and that Flits is the platform.

2.3 The venue decides what the deal is: the discount or price, the conditions, the time window, availability and product information such as allergens. The venue is responsible for that information being correct, for honouring the deal and for the quality and safety of what you receive.

2.4 With a takeaway deal, you enter into a purchase contract with the venue. The venue is the seller. Flits processes the payment on the venue's behalf through our payment partner Stripe. Your receipt shows the venue as seller and Flits as platform.

2.5 With a table deal, there is no payment in the app. You pay at the venue, with the discount taken off your bill.

2.6 A discount is always measured against the venue's normal menu price. Fake discounts are not allowed. If you think a discount isn't genuine, report it in the app.

2.7 The order of deals in your feed depends mainly on distance, your preferences, the saving, whether you can make it in time, the venue's quality and your past visits. Sponsored cards are always labelled "Sponsored" and are not ranked higher in the regular order.

3. Your account

3.1 You can browse without an account. You need one before your first claim or purchase.

3.2 You sign in with your email address and a 6-digit code that we email to you. A code is valid for 10 minutes. After your first sign-in, you enter your first name. We don't accept disposable email addresses.

3.3 Before your first claim or purchase, you confirm your mobile number once with a text message code. If the text doesn't arrive, you can also receive the code via WhatsApp. We only use your number for verification and to prevent abuse. Venues never see your number.

3.4 One number belongs to one account, and everyone may have only one account. You can change your number in the app, no more than once every 30 days. After a change, your old number stays linked to your account for 90 days for strikes and blocks.

3.5 No more than 2 accounts can claim or buy deals on the same device within 30 days. A third account is blocked from claiming and buying on that device.

3.6 Keep your email and phone secure. Anything done through your account counts as done by you, unless you can show that someone else gained access through no fault of your own. If you notice misuse of your account, tell us straight away.

3.7 Give accurate details and keep them up to date.

4. Age

4.1 Flits does not ask for your date of birth and does not check your age. If you are under 16, you may only use Flits with the permission of your parent or guardian, who also gives consent for location, notifications and the newsletter.

4.2 Deals that include alcohol are only for people aged 18 or over. Before your first alcohol deal, you confirm once in the app that you are 18 or older. We only store that you confirmed this and when. Your ticket says "ID may be requested". The venue checks your age and may refuse to serve you alcohol if you cannot show ID. See the Alcohol Policy for more.

4.3 Takeaway deals never include alcohol.

5. Table deals

5.1 Claiming. You claim a table deal for free in the app. You choose how many people are coming and roughly when you'll arrive. You can add a short note for the venue. Only claim if you're really going.

5.2 Deal conditions. Before you claim, you see the discount, any minimum spend, exclusions and the cancellation rule. The conditions that applied when you claimed stay in force for your claim.

5.3 Arrival window. After claiming, you have a set arrival window to get there. You see it before you claim and afterwards on your ticket.

5.4 Claiming rules.

  • You can have 1 active table claim at a time. Takeaway orders don't count towards this.
  • At any one venue, you can make no more than 1 table claim per day and 4 per month. A venue can change this limit for its own location.
  • Your party size on arrival may differ by 1 person from what you claimed. The discount applies per checked-in person or per table, as stated in the deal.
  • If your reliability score is below 30, you can claim for no more than 2 people per claim (see section 7).

5.5 Checking in. At the venue, show your QR code or 6-digit code. Staff scan it or type it in. That checks you in, and staff take the discount off your bill.

5.6 "I'm here". If you're at the venue on time but checking in doesn't work, tap "I'm here" while you are at the venue. The venue is then asked whether you were there. If the venue confirms, you are checked in after all. If the venue says no, or doesn't respond within 2 hours, you don't get a strike and our support team looks into it.

5.7 Group claims. You can share your claim with your party via a link. Anyone opening the link sees the venue, the time and directions; the ticket itself stays with you. You can change the party size until the end of the arrival window.

5.8 Waiting list. If a deal is full, you can turn on a notification. When a spot frees up, the first three people on the waiting list are notified and get 2 minutes' priority. After that, the spot is open to everyone.

5.9 Changes by the venue. A venue can pause, extend or end a live deal. Your existing claim remains valid. A venue may increase the discount on a live deal (you then get the higher discount too) but may not reduce it. If the venue makes an emergency cancellation, all claims are cancelled, with no strike for you.

6. Cancellations, no-shows and strikes

6.1 You can cancel free of charge up to 10 minutes before the end of your arrival window. The spot is then released for someone else.

6.2 If you cancel later, that's a late cancellation. You get half a strike and your reliability score drops by 6 points. A half strike is shown in your overview but does not count towards the claim blocks in 6.4.

6.3 If you haven't checked in by the end of your arrival window (and haven't used "I'm here", see 5.6), you are a no-show and get a strike. The venue can only mark you as "Didn't show" after your window has ended.

6.4 Consequences of no-show strikes, counted over the last 60 days:

6.5 A strike expires after 90 days. For the blocks in 6.4 we count the strikes of your account and of other accounts that claimed deals on the same device. Because one number belongs to one account (3.4), a new account won't get you out of a strike either.

6.6 If the venue cancels, or makes an emergency cancellation, you don't get a strike.

6.7 If you disagree with a strike, you can appeal in the app (Profile → Reliability). See also section 13.

7. Reliability score

7.1 For table deals, you have a reliability score from 0 to 100. You start at 80.

7.2 Consequences:

  • Score below 50: you're less likely to be notified about new deals.
  • Score below 30: you can claim for no more than 2 people per claim.

7.3 Venues don't see your score. They only see the label "Top guest" (score of 90 or higher) or "New" (fewer than 3 claims), and otherwise nothing.

7.4 There is no score for takeaway deals, because you pay in advance.

8. Takeaway deals

8.1 Buying. With a takeaway deal, you buy a product or bundle from the venue at a fixed price. Before you buy, you see the price, the normal value, the pick-up window, the allergens and the cancellation rule.

8.2 Paying. You pay straight away in the app via Stripe, using Apple Pay, iDEAL | Wero or a card. Your card details are stored by Stripe; Flits only sees the card brand and the last 4 digits. While you check out, we hold the product for you for up to 10 minutes. Your bank statement shows "FLITS*" followed by the venue's name.

8.3 No extra costs. You only pay the deal price. There are no service fees.

8.4 Picking up. You collect your order during the pick-up window. Staff scan your QR code or code, or you use "Swipe to collect". Swiping only works during the pick-up window and when you are within 150 metres of the venue. Then show the moving confirmation screen to staff. If the deal says "Bring your own bag/container", please do.

8.5 Not collected. If you don't collect your order during the pick-up window, you don't get your money back. The product was set aside for you.

8.6 Cancellations, refunds and complaints. When you can cancel, what happens if the venue cancels and how to complain are set out in the Cancellation & Refund Policy. In short: you can cancel free of charge up to 2 hours before the pick-up window starts; if you buy within those 2 hours, you can cancel up to 5 minutes after buying. Report a complaint about quality or contents in the app within 24 hours after the pick-up window.

8.7 Right of withdrawal. Takeaway deals are goods that spoil quickly. The statutory 14-day right of withdrawal does not apply to them. Instead, our own, more generous cancellation scheme applies. See the Cancellation & Refund Policy.

8.8 Allergens. For every takeaway deal, the venue states which of the 14 EU allergens the product contains or may contain. You see this before you buy. For a surprise bag, all allergens that could be in it are listed. If you've marked allergens in your taste profile, we highlight them and ask you to confirm that you've read the information. The venue is responsible for the accuracy of the allergen information and for food safety, including shelf life and refrigeration until the end of the pick-up window. If in doubt, contact the venue before you buy. For table deals, ask the staff about allergens. More information is on our allergens page.

8.9 Dietary labels such as vegetarian, vegan or halal are only shown if the venue confirms them.

8.10 Alcohol. Takeaway deals never include alcohol.

9. Flits credit

9.1 Flits credit is credit that Flits gives you. You use it when paying for a takeaway deal: it is deducted from the price automatically. Flits pays the credit to the venue, so the venue still receives the full amount. You cannot use credit for table deals, because you pay for those at the venue.

9.2 You receive credit in these cases:

  • Inviting friends: share your personal link or code. If your friend enters it before their first claim or order, you both get €2 Flits credit once your friend has redeemed their first deal. An invite code can be used once, not for yourself, and not if the phone number on your account has already used an invite.
  • Compensation: if a table deal isn't honoured and we uphold your report, you get €5 Flits credit (see section 11).
  • Credit returned: if you paid for a takeaway order (partly) with credit and that order is cancelled or refunded, the credit part comes back to you as credit (see the Cancellation & Refund Policy).

9.3 Credit cannot be exchanged for cash, cannot be transferred to another account and can only be used in the app.

9.4 Credit does not expire. The app shows your balance.

9.5 If someone obtains credit unfairly, for example through fake accounts or by inviting themselves, we may withdraw it.

9.6 If you delete your account, any unused credit lapses once the account is permanently deleted (after the 30-day restore period, section 17).

10. Notifications and location

10.1 Notifications. With your permission, we send you push notifications about deals nearby. By default you get no more than 3 a day; you can set this to 1, 2, 3 or 5. By default, quiet hours run from 22:30 to 10:00. Notifications about your own claim or order (such as a pick-up reminder or a reply from support) don't count towards that limit. You can always change or turn off notifications in the app or in your iOS settings.

10.2 We don't use email for deals. We email you sign-in codes, receipts, refunds and replies from support. You only get a newsletter if you give separate permission for it.

10.3 Location. With your permission, we use your location to show deals nearby. We round your location and delete it after 24 hours. Your location is never shared with venues. We only ask for permission to use your location when the app is closed ("Always") after your 2nd redemption. If you don't give permission, you choose a city instead. You can withdraw your permission at any time in your iOS settings.

10.4 When you use "Swipe to collect" or "I'm here", we check that you are at the venue. More details are in the Privacy Notice.

11. Reviews and reports

11.1 You can only review a venue after redeeming a deal there. The venue may reply publicly to your review once.

11.2 Your review must be honest and about your own experience. What is and isn't allowed is set out in the Review & Moderation Guidelines. We only remove a review if it breaks the guidelines or the law.

11.3 If you choose "Deal not honoured" or "Product didn't match" in your review, we open a report. The venue has 48 hours to respond. We then assess the report:

  • Upheld for a table deal: the venue gets a warning or suspension under our rules, and you get €5 Flits credit.
  • Upheld for a takeaway deal: you get your money back under the Cancellation & Refund Policy.

11.4 For every deal, venue and review, you can report illegal content or a breach of the rules. We review every report and let you know what we've done about it.

11.5 Only make reports that are truthful. False or repeated unfounded reports count as misuse (section 12).

12. What's not allowed

You may not use Flits to:

  • have more than one account, create accounts with a fake identity or disposable email address, or share your number with others;
  • get around strikes, blocks or claim limits, for example by using another account, device or number;
  • claim deals you don't intend to use;
  • use "Swipe to collect" when you're not at the venue, show a screenshot of the collection screen, or collect an order that isn't yours;
  • submit false complaints, reports or reviews, or mislead venues or other users;
  • resell deals, codes or credit;
  • disrupt, hack, automatically harvest (scrape) or copy the app, the website or our systems;
  • post content that is unlawful, offensive, discriminatory or misleading, or that contains contact details or advertising;
  • intimidate or harass venue staff or Flits employees;
  • do anything that breaks the law.

13. Enforcement and appeals

13.1 If you don't comply with these terms or the guidelines, we may take action. For example: a strike, a temporary claim block, removing or hiding your review, withdrawing credit, or temporarily or permanently blocking your account. If we block an account, we may also block the phone number, so it can't be used to create a new account.

13.2 Whenever we take action, you receive a statement of reasons in the app: which rule is involved, which facts we're relying on and how you can appeal.

13.3 You can appeal in the app. A different staff member from the one who made the decision handles your appeal within 5 working days. We tell you the outcome and the reason.

13.4 If you still disagree, you can turn to a certified out-of-court dispute settlement body under the Digital Services Act, or to the courts.

13.5 Our action is proportionate to the breach. In cases of serious abuse or fraud, we may block an account immediately.

14. Liability

14.1 Flits is a platform. The venue is responsible for the deal, the products and the service at the venue, including allergen information, food safety and age checks for alcohol. If you suffer loss because of what the venue does or supplies, you claim against the venue. Our support team will help you, and for a takeaway order we arrange a refund under the Cancellation & Refund Policy.

14.2 Flits is liable to you under the law for loss resulting from a failure by Flits in its own service, such as processing your payment.

14.3 A deal is available as long as the venue offers it and there is space or stock (section 15). A deal being full, ended or no longer visible does not entitle you to compensation.

14.4 Nothing in these terms limits your mandatory rights as a consumer.

15. Availability

15.1 We do our best to keep Flits working properly and without interruption, but we can't guarantee it. Sometimes Flits is temporarily unavailable, for example because of maintenance, updates or outages on our side or at our service providers.

15.2 Deals are available as long as the venue offers them and there is space or stock. A deal you see in the feed may already be full or ended by the time you open it.

15.3 We are not liable if we cannot meet our obligations due to force majeure, such as outages of internet, telecoms or payment services, or government measures. If an order you've already paid for cannot go ahead as a result, we refund it.

15.4 We may change or improve features of the app. If a significant feature for guests is lost as a result, we'll let you know in advance.

16. Intellectual property

16.1 The app, the website, the Flits name and logo and all software and design belong to Flits or our licensors. You receive a personal, non-transferable right to use the app for your own non-commercial use, in line with these terms.

16.2 Photos, text and logos of venues belong to the venue or its licensors.

16.3 If you post a review, text or photo, it remains yours. You give Flits a free, non-exclusive licence to display that content in the app and on the website alongside the venue for as long as it is online. You confirm that you have the right to post that content.

17. Deleting your account and termination

17.1 You can delete your account at any time in the app (Profile → Privacy & data). You confirm this with Face ID or an email code.

17.2 What happens to open claims and orders:

  • An open table claim is cancelled, without a strike.
  • If you have a takeaway order that hasn't been collected yet, you can only delete your account once it is settled: collect the order, or cancel it with a refund if that's still possible within the cancellation period (see the Cancellation & Refund Policy). Until then the app tells you why deletion isn't possible yet.

17.3 After deletion, you have 30 days to restore your account. After that, we delete or anonymise your data. We keep some data, such as payment records and invoices, for longer because the law requires it. See the Privacy Notice.

17.4 If you own a venue on Flits, you must first transfer ownership or close the organisation.

17.5 We may terminate your account if you seriously or repeatedly breach these terms (section 13), or if we discontinue the service. If we discontinue the service, we'll tell you at least 30 days in advance and settle open orders properly.

18. Changes to these terms

18.1 We may change these terms, for example when we add features or when the law changes.

18.2 If a change matters to you, we'll let you know at least 30 days in advance in the app or by email. If you don't agree, you can delete your account before the change takes effect. If you keep using Flits after that, the new terms apply.

18.3 Changes that are only to your benefit, or that are required by law, may take effect immediately.

18.4 A claim or order is governed by the terms in force when you claimed or bought.

19. Complaints and contact

19.1 If you have a question or complaint, go to Profile → Help in the app. You can start a conversation there with your claim or order already attached. If you're at the venue right now, tap "I'm at the venue now" and we'll deal with your question first.

19.2 You can also email info@nafite.com.

19.3 We reply as quickly as possible, and with a full answer within 14 days at the latest. If that's not possible, we'll tell you when you can expect an answer.

19.4 For complaints about a takeaway order, the time limits in the Cancellation & Refund Policy also apply.

20. Governing law and disputes

20.1 These terms and your use of Flits are governed by Dutch law. If you live in another country, you keep the mandatory protection that the law of your country of residence gives you as a consumer.

20.2 If we can't resolve a dispute together, you can bring it before the court that has jurisdiction under the law.

20.3 If any provision of these terms is invalid, the other provisions remain in force. We will replace the invalid provision with one that comes as close as possible to its purpose.

20.4 These terms are available in Dutch and English. If the two differ, the Dutch text prevails.
